Art. 1. These Terms and Conditions govern the relationship between "PROODOS I" LTD (referred to hereinafter as the PROVIDER), with its registered office at Angel Simonov St. 20, Bratsigovo, Bulgaria, and the USERS of the e-commerce platform available at www.devafashion-shop.com (hereinafter referred to as the "ONLINE STORE").

Art. 2. Pursuant to the requirements of the European Union’s e-commerce regulations and consumer protection laws, the PROVIDER provides the following information:

III. CHARACTERISTICS OF THE ONLINE STORE

Art. 3. Through the ONLINE STORE available at www.devafashion-shop.com, USERS can:

  1. Register and create an account to access additional features and information.

  2. Place online orders for products offered by the ONLINE STORE.

  3. Execute electronic payments for purchased products using supported payment methods.

  4. Receive updates and notifications about new products and services.

  5. Browse and view product details, prices, and delivery terms.

  6. Exercise their right to withdraw from contracts entered into remotely, in compliance with applicable regulations.

Art. 4. The PROVIDER ensures that goods and services delivered conform to the USERS’ rights under applicable consumer protection laws. USERS are responsible for maintaining the confidentiality of their account credentials and for any activity that occurs under their account. The PROVIDER reserves the right to disable USER accounts for failure to comply with these terms, misuse, fraudulent activity, or breach of security.

Art. 5. USERS and the PROVIDER agree that all communications regarding contract execution can be conducted electronically in compliance with EU e-commerce laws. Furthermore, the PROVIDER reserves the right to disable USER accounts for failure to comply with these terms or if misuse, fraudulent activity, or breach of security is detected.


IV. USER ACCOUNT AND ONLINE STORE USAGE

Art. 6. USERS may utilize the ONLINE STORE without registration; however, full functionality may require account creation.

  1. Upon registration, USERS must provide accurate and current data and agree to the Terms and Conditions.

  2. The PROVIDER is not liable for the USER's inability to access certain features due to missing or incorrect account information.

  3. USERS must maintain the confidentiality of their account credentials and promptly notify the PROVIDER of any unauthorized access or security breaches.


V. PURCHASE AGREEMENT TERMS

Art. 7. USERS can place orders by selecting products and providing accurate delivery details. The following conditions apply:

  1. All prices include VAT and applicable taxes.

  2. Delivery fees are calculated separately and depend on the USER's location.

  3. Payments for international orders must be made in advance using debit/credit cards.

  4. Free delivery is available for orders exceeding €89 within the European Union.

  5. By placing an order, USERS agree to provide accurate information and accept these Terms and Conditions.

Art. 8. Orders are confirmed once payment is successfully processed. The PROVIDER reserves the right to refuse orders due to technical errors, fraudulent activity, or stock availability. USERS will be notified promptly if an order cannot be fulfilled.


VI. DELIVERY TERMS

Art. 9. Delivery terms are as follows:

  • Orders within Bulgaria are dispatched within 1–3 business days after confirmation.

  • Orders to selected EU countries (Romania, Greece, Cyprus, Croatia, Slovenia, Hungary, Slovakia, Poland, Czech Republic, Germany, Italy, Spain, France) are processed within a similar timeframe and delivered within 2–8 business days, depending on the destination.

  • Shipping fees are calculated automatically at checkout and vary by country. Free shipping applies for orders exceeding the relevant threshold (e.g. 79 BGN for Bulgaria, 59–149 EUR for international orders, depending on destination).

  • Delivery outside Bulgaria is carried out by reliable local courier partners, though the PROVIDER does not specify the exact courier in each case.

  • Orders may require a signature upon receipt. The USER is responsible for ensuring someone is available to accept the delivery.

  • In high-demand periods, processing time may be extended up to 10 business days.

Art. 10. USERS must inspect the goods upon delivery. Any complaints regarding incorrect, damaged, or missing items must be reported within 14 days of receipt. If an item is missing or incorrect, it will be replaced within 3 business days at no extra cost to the USER.


VII. RIGHT OF WITHDRAWAL

Art. 11. In compliance with EU Directive 2011/83/EU, USERS may withdraw from a purchase agreement within 14 days of receiving the goods, under the following conditions:

  1. Goods must be returned in their original, unused condition with intact packaging.

  2. Return shipping costs are borne by the USER unless the PROVIDER shipped incorrect or defective items.

  3. Refunds will be processed to the same payment method used for the original transaction within 14 days after the returned goods are received:

    • If the payment was made by card, the refund will be issued as a reversal to the same card.

    • If the payment was made via bank transfer, the refund will be processed to the original bank account.

    • USERS must provide proof of return shipment, such as a tracking number.

  4. Certain goods, such as personal care products, are non-returnable due to hygiene reasons unless they are defective or damaged upon receipt.

  5. Goods must be returned in their original, unused condition with intact packaging.

  6. Return shipping costs are borne by the USER unless the PROVIDER shipped incorrect or defective items.

VIII. LIABILITY AND LIMITATIONS

Art. 12. The PROVIDER is not liable for:

  1. Delays caused by external courier services.

  2. Variations in product colors due to screen differences.

  3. Losses incurred due to USER errors in order placement.

  4. Unauthorized use of USER accounts caused by negligence in protecting login credentials.

Art. 13. USERS agree to use the ONLINE STORE in good faith and to comply with applicable laws and regulations. Misuse, fraudulent activity, or attempts to compromise the platform’s security are strictly prohibited.

Art. 14. The PROVIDER’s total liability, regardless of circumstances, is limited to the amount paid by the USER for the specific order in question.


IX. DATA PROTECTION AND PRIVACY

Art. 15. The PROVIDER adheres to the General Data Protection Regulation (EU) 2016/679 (GDPR). Personal data collected during order placement is used solely for order processing and delivery.

  1. USERS can request access, correction, or deletion of their personal data at any time.

  2. The PROVIDER may use anonymized data for statistical purposes to improve its services.

  3. The full Privacy Policy is available on the ONLINE STORE website.

  4. The PROVIDER implements technical and organizational measures to ensure the security of USER data.


X. CHANGES TO TERMS AND CONDITIONS

Art. 16. The PROVIDER reserves the right to amend these Terms and Conditions. USERS will be notified of any changes, and continued use of the ONLINE STORE constitutes acceptance of the updated Terms.


XI. GOVERNING LAW AND DISPUTE RESOLUTION

Art. 17. These Terms and Conditions are governed by the laws of the European Union and Bulgaria. Disputes will be resolved by the competent courts in Bulgaria or through the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).

Art. 18. In the event of any discrepancy between the English and Bulgarian versions of these Terms, the Bulgarian version will prevail.
